The law firm of Cornell Grace, P.C. won a defense verdict today in favor of its client, the Rockefeller University, in the matter of Temperino v. Rockefeller University et al., Kings County Index No. 15040/2005. Firm founder Janet O’Connor Cornell served as lead counsel throughout the five-year litigation, and successfully tried the case to verdict in a six day trial.
Also successfully defending the matter was co-defendant DRA, Inc. by its owner Richard Arrabito, with trial counsel Edward v. Sapone, Esq.
Mr. Temperino, a 35-year-old union electrician, claimed that he fell from a ladder while performing construction work on a laboratory at Rockefeller University. Plaintiff asserted claims under New York State Labor Law sections 200, 240(1) and 241(6), seeking a multi-million dollar verdict. The jury unanimously rejected his claim at the conclusion of the liability phase of the trial, finding plaintiff was the sole proximate cause of his own accident
